In this Policy, we use the word “Subscriber” to refer to anyone who has subscribed to or paid for use of our Services. We use the word “you” to refer to any other individual user of our Services, such as an employee of a Subscriber, a customer of our Subscribers, or an individual browsing or using our Website and Services.

1. Entities and this Policy

This privacy policy applies to the Yocale Network Corporation website located at www.yocale.com (the “Website”) and the services provided by Yocale Network Corporation (collectively, the “Services”). By accessing and using this Website or the Services, you shall be deemed to have accepted and agreed to the terms set forth by our “Privacy Policy.”

This Privacy Policy may be changed from time to time. We will update this Privacy Policy from time to time. If we make significant changes to this policy, such as to comply with new legal requirements, we will provide you with 30 days' notice so that you can make an informed choice about your use of our services.  

By submitting your personal information to us, by registering for or using any of the Services we offer, by using our Website, or by voluntarily interacting with us after we publish or communicate a notice about the changes to this Privacy Policy, you consent to our collecting, using and disclosing your personal information as set out in the revised Privacy Policy.

2. Personal Information and Consent

For the purposes of this Privacy Policy, “personal information” means any information about an identifiable individual, or as otherwise defined under applicable laws.

We are not responsible for the privacy or data security practices of our subscribers, which may differ from those set forth in this Privacy Policy. Yocale does not choose or determine the categories of Collected Information that relates to the Personal Data. Subscribers solely determine the Personal Data and are responsible for use beyond the Services.

This Privacy Policy does not apply to the extent we process personal information in the role of a processor or service provider on behalf of our subscribers. It is that subscriber’s privacy statement that applies; we conduct such activities strictly in accordance with our subscriber’s instructions and pursuant to our contractual arrangements with the subscriber. If you are an end user or consumer with an existing relationship with one of our subscribers, you should refer to the subscriber’s website to understand their privacy practices and policies.

The primary basis on which we collect, use and disclose your personal information is with your consent, unless otherwise permitted or required by law.  How we obtain your consent will depend on the circumstances, as well as the sensitivity of the information collected.  Subject to applicable laws, your consent may be express or implied, depending on the circumstances and the sensitivity of the personal information in question.  If you choose to provide personal information to us, we assume that you consent to the collection, use and disclosure of your personal information as outlined in this Privacy Policy.

Typically, we will seek your consent at the time your personal information is collected. Where we want to use your personal information for in a purpose not previously identified to you at the time of collection, we will seek your consent prior to our use of such information for this new purpose. You have the right to withdraw consent at any time.

To withdraw consent, please email our support team at privacy@yocale.com. Before we implement the withdrawal of consent, we may require proof of your identity. In some cases, withdrawal of your consent may mean that we will no longer be able to provide certain products or services. Please also note that certain data will remain within the Services for us to fulfill our contractual obligations, even after you withdraw your consent.

If you provide personal information about another individual to us, it is your responsibility to obtain the consent of that individual to enable us to collect such information from you, and to use and disclose his or her information as described in this Privacy Policy.

3. Our Collection of Personal Information

When you visit and/or use the Website or communicate with us via email, social media, live chat, or contact forms located on the Website, we may ask for personal information that will be used in accordance with this Privacy Policy.

We may collect, use, and disclose different types of personal information, depending on our relationship with you. Generally, we collect the following types of personal information (not all of which may apply to you):  

  • identity information, such as your name, username or similar identifier, title, date of birth and gender;
  • contact information, such as your billing address, delivery address, e-mail address and telephone numbers;
  • financial information, such as your bank account number and payment card details used to purchase products or services; and
  • technical and usage information when you use our website, such as your internet protocol (IP) address, login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access our website.

We also collect, use, and share aggregated and anonymized data for any purpose. Aggregated and anonymized data is not considered personal information because it cannot be used to identify you.

Subscriber Data

Yocale’s subscribers control the types of data that they upload to the Services, which may include additional data types to those listed in this Privacy Policy. Where Yocale uses Personal Information uploaded by subscribers that is protected by additional privacy laws, such as health privacy laws, Yocale may agree to additional terms with their subscribers.

4. Use of Personal Information

We may use your personal information and other information that we collect to provide the Services, to comply with our contractual obligations, and to support our legitimate interests in maintaining, improving and advertising the Services. Below are the specific purposes for which we use the information we collect about you.

  • To provide the features and functionality of the Website and Services, including without limitation, to (i) search and find businesses and providers in your local community; and (ii) engage with, schedule appointments with, and rate, review and rank the business or provider.

Yocale may disclose an individual’s personal information to others in connection with the purpose for which it was collected, as consented to by the individual, or as required or permitted by law. We will ask for explicit consent in the event of processing special categories of data and as required by law.

You also may provide personal information to be transmitted to other users of the Website or service providers (collectively, “User Contributions”). Your User Contributions are published or displayed on the Services and are transmitted to others at your own risk. We cannot control the actions of other users of the Services with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Yocale may share your personal information in the certain situations. Examples of where your personal information may be disclosed include:

  • We may share your personal information when you find businesses or providers through the features and functionality of the Website and schedule appointments with the business or provider.
  • We may share your personal information with businesses or providers or other users of the Services when you access features of the Services that enable you to contact businesses or providers or other users with respect to a search for certain services.

We share your personal information with third party service providers who perform some functionality within the Website and Services on our behalf. These include, but are not limited to:

  • Hosting Providers: For storing and managing data securely.
  • Payment Processing Companies: For handling credit card transactions and other forms of payment.
  • Communication Services: For sending emails, notifications, or other communications.
  • Survey and Analytics Providers: For conducting surveys and analyzing user data to improve our services.
  • Fraud Prevention Services: For detecting and preventing fraudulent activities.
  • IT and Technical Support Services: For maintaining and troubleshooting our Website and Services.
  • Consultants and Vendors: For specific operational needs, such as marketing or business development.

If we provide your information to service providers for our provision of the Services, then we require that service providers maintain the confidentiality of your personal information and keep your personal information secure. Yocale is not responsible for the actions of any independent third parties you may choose to engage with directly, nor are we responsible for any additional information you provide directly to any third parties, except for those acting on Yocale’s behalf, and we encourage you to become familiar with their privacy practices before disclosing information directly to any such parties.

Other Disclosures

Additionally, we may disclose your information when we believe such disclosure is permitted, necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce the terms of the agreements for our products and services; (e) to protect our operations or those of any of our affiliates or subsidiaries; (f) to protect our rights, privacy, safety or property, and/or those of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.  In addition, we may transfer your personal information and other information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, brands, affiliates, subsidiaries or other assets.

If we otherwise intend to disclose your personal information to a third party, we will identify that third party and the purpose for the disclosure and obtain your consent.

6. Automated Decision Making and Your Rights

Yocale uses automated decision-making (ADM) processes in limited circumstances to enhance the efficiency and quality of our services. These processes include:

  • Appointment Matching: Automated algorithms may analyze user preferences and availability to suggest suitable appointment slots.
  • Fraud Detection: Automated systems monitor activity to identify potentially fraudulent transactions or behaviors.
  • Personalized Recommendations: Based on user behavior and preferences, we may use.

Yocale only tracks logins into the Yocale app when logged in with Intercom. Behaviour is also tracked in Fullstory. Lastly, Yocale takes your information to create an account for both Facebook and Google registration.

7. Data Retention

We will store your personal information securely on Microsoft Azure servers which use Advanced Encryption Standard (AES 256) encryption. We will maintain your personal information for as long as they are needed, or as required by applicable laws, regulations, or government orders. After the relevant amount of time has passed, we will delete your information. The general retention periods for data that we hold are as follows.  

• Subscriber Data: We retain subscriber data for as long as an account is active, and for a reasonable time after account termination.  We will retain some of your information as necessary to comply with our legal obligations, to resolve disputes, to enforce our agreements, and to support business operations.

• Services Improvement and Development: Where we retain information for Service improvement and development, we take steps to make that information non-personal, non-identifiable and anonymous. We only use this information to uncover collective insights about the use of our Services, and not to specifically analyze personal characteristics about you.  

• Information you share on the Services: If your account is deactivated or disabled, some of your information and the content you have provided will remain in order to allow your team members or other users to make full use of the Services.  

• Managed accounts: If the Services are made available to you through an organization (e.g., your employer), we retain your information as long as required by the administrator of your account.  

• Marketing information: If you have elected to receive marketing emails from us, we retain information about your marketing preferences for a reasonable period of time from the date you last expressed interest in our Services, such as when you last opened an email from us. We retain information derived from cookies and other tracking technologies for a reasonable period of time from the date such information was created.  

8. Rights to Your Information & How to Request the Removal of Personal Data

Individuals have a number of rights concerning their personal information under global privacy laws. You may make a written request to access, correct or delete any personal information about you that we have collected, used or disclosed, and we will provide you with any such personal information to the extent required by law. You may also challenge the accuracy or completeness of your personal information in our records. If you successfully demonstrate that your personal information in our records is inaccurate or incomplete, we will amend the personal information as required. If you provided personal information to a Subscriber and believe it is being processed by us on behalf of that Subscriber, please make any requests or queries regarding that personal data to the Subscriber directly.

Where applicable, you may be entitled to additional rights, including: (i) the right to withdraw consent to processing; (ii) the right to object to unlawful data processing, under certain conditions; (iii) the right to deletion or to ask for the de-indexation of personal information about you, under certain conditions; (iv) the right to demand that we restrict processing of your personal information, under certain conditions, if you believe we have exceeded the legitimate basis for processing, processing is no longer necessary, or believe your personal information is inaccurate; (v) the right to data portability of personal information concerning you that you provided us in a structured, commonly used, and machine-readable format, under certain conditions; (vi) the right to object to decisions being taken by automated means which produce legal effects concerning you or similarly significantly affect you, under certain conditions.

Please note that such rights are not absolute. There are instances where applicable law or regulatory requirements allow or require us to refuse to provide some or all of the personal data that we hold about you. In the event that we cannot accommodate your request, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

You also have the right to lodge a complaint with the relevant data protection or privacy authority, such as the Office of the Privacy Commissioner.

We may require that you provide sufficient identification to fulfill your request to access or correct your personal information.  Any such identifying information will be used only for this purpose. We will not charge you any fees to access your personal information in our records without first providing you with an estimate of the approximate fees, if any.  To make changes or to request the deletion or removal of your personal data, please email our technical support team at privacy@yocale.com

9. International Transfer and Storage of Information

Personal information may be processed in any country where we have facilities or in which we engage third party service providers to fulfil the purpose for which we collected the personal information. As a result, your personal information may be transferred to countries outside your country of residence, which may have different data protection rules than in your country.  While such information is outside of your country, it is subject to the laws of the country in which it is located, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of such other country, pursuant to the laws of such country.

In the case of any transfer of your personal information to other countries, we will implement appropriate safeguards to provide an adequate level of protection. Our practices regarding your personal information will at all times continue to be governed by this Privacy Policy and we will continue to comply with all applicable legal requirements. The Website may contain links to other websites. This Privacy Policy does not apply to other websites and services, and we are not responsible for the privacy practices or the content of such websites and services. Their privacy policies and practices may differ significantly from our policies and practices.

11. Cookies and Log Files

A “cookie” is a small text file that contains information and is stored on your computer. We use cookies and similar tracking technologies, such as web beacons and pixels, to automatically collect information about your use of our website and your interaction with our emails. Information we collect may include your IP address (or proxy server), device and application identification numbers, location, browser type, internet service provider and/or mobile carrier, pages and files viewed, searches, operating system and system configuration information, and date/time stamps associated with your usage.

We use this information to facilitate the use of our website, for our business or analytical purposes (including to assess website traffic and track search criteria), and to personalize web pages according to your choices and interests.

We use cookies and similar technologies to enhance your experience, improve the functionality of our website, and engage in interest-based advertising. We will strive to prevent unauthorized access to your personal information, however, no data transmission over the Internet, by wireless device or over the air, is guaranteed to be 100% secure. We will continue to enhance security procedures as new technologies and procedures become available. Please remember that you control what personal information you provide while using the Website and Services. Ultimately, you are responsible for maintaining the secrecy of any personal information provided in connection with the use of the Website and Services.

Always be careful and responsible regarding your personal information. We are not responsible for, and cannot control, the use by others of any information which you provide to them, and you should use caution in selecting the personal information you provide to others through the Website and Services.

Similarly, we cannot assume any responsibility for the content of any personal information or other information which you receive from other users through the Website or Services, and you release us from any and all liability in connection with the contents of any personal information or other information which you may receive using the Website and Services. We cannot guarantee, or assume any responsibility for verifying, the accuracy of the personal information or other information provided by any third party. You release us from any and all liability in connection with the use of such personal information or other information of others.

13. Why do we ask you to consent to electronic communications?

Because you are most likely signing up to Yocale to book appointments with a certain provider (doctor, dentist, hairdresser, etc..), and in order for us to confirm your bookings as well as notify you of changes to these bookings, we must send you an email / SMS (depending on your settings).

When you book an appointment on Yocale, the following will take place:

  • We will send you a confirmation email to the email you registered with
  • We will send you a confirmation SMS to the mobile number you specified in your profile (you can turn this on or off at any time)
  • We will schedule one or two reminder emails (depending on the provider’s cancellation policy) to remind you of your appointment (usually 24 hours before cancellation deadline and before appointment date)
  • We will schedule one or two reminder SMS messages (depending on the provider’s cancellation policy) to remind you of your appointments (You can turn SMS on or off at any time)
  • We will send you a post-appointment email (receipt, review) to ask you how the appointment went. In some cases, provider may turn these off so you would not receive these emails.
  • If your provider changes or cancels the appointment for any reason, we will send you an email / SMS notification informing you of this change.

At any point in time, you can choose to unsubscribe from all these emails / SMS messages by clicking on the unsubscribe link at the bottom of any email your receive or replying “STOP” to any of the SMS messages you receive. Just note however that this will stop all emails and SMS messages from all Yocale providers, and you will no longer receive any of the emails or SMS messages listed above.
